In England a man has been cleared of rape because he was sleep walking.
I wonder, have any of you heard of such a thing before or is this setting some kind of precendent in law. I personally think it has quite a few ramifications. If sleep walking is done in the somnambulistic state and this man raped someone in that state, did he have the unconscious intention and desire to perform the act.

I have heard the old saying that "every man is a potential rapist" which is obviously true because thats the sort of equipment males carry around with them.

Surley even in the sleep walking state their should be some kind of mechanism to prevent this sort of behaviour. Unless, as I've written, he truly did have the potential and desire to perform such an act.

It is very difficult to predict and often times explain what a jury will do.

The man in this case is claiming it wasnt rape because he was as, or more, impared than the woman.

While I have to admit to 'waking up' in interesting "sexual situations" with partners, I find it very difficult to believe someone could complete intercourse, voluntary or otherwise, and remain asleep.

This is true only to the same degree that every woman is a potential whore.
